PRIVACY & COOKIES POLICY
2. Collection of Personal Data
2.1. The types of Personal Data collected and stored by WGSN might include name, date of birth, e-mail address, postal address, telephone number, fax number and credit/debit card details (to the extent permitted by the Data Protection Act 1998 and related legislation (“the DPA”).
2.2. WGSN (or any of its sub-contractors) may collect personal information about Visitors in the following ways:
(i) any data which Visitor provide when Visitor completes and submits an application to WGSN in order to register on its website(s) or to receive email alerts or other communications from WGSN;
(ii) any data that Visitor provides via postings to forums and blogs and any other posting that Visitor makes to an WGSN website (in such circumstances the information posted by Visitor will also be available to Visitors of the website throughout the world);
(iii) during any transaction with WGSN; and
(iv) any other data which Visitor provides to WGSN when enquiring about the content of the site, email, telephone or write to WGSN or otherwise provide WGSN with personal information.
2.3. WGSN (or any of its sub-contractors) may also receive Personal Data from third parties, for example a Visitor who wants to tell a friend about one of WGSN’s websites.
3. Storage and retention of Personal Data
3.1. WGSN will keep Visitor’s Personal Data on a secure server. The technology that WGSN uses and the security policies which WGSN has implemented are intended to safeguard Visitors’ Personal Data from unauthorized access and improper use.
4. Use of Personal Data
4.1. WGSN may use the Personal Data (subject in each case to the requirements of the DPA) for the following purposes:
(i) administering Visitor’s website account(s) and otherwise in connection with any service for which Visitor has provided Personal Data, including any email alerts, transactions with WGSN, competitions and promotions that Visitor takes part in;
(ii) responding to any enquiry Visitor makes to WGSN;
(iii) subject to Visitor’s consent, sending newsletters and/or alerts and information regarding WGSN’s or any third party’s future services (in all formats to which Visitor has consented e.g. post, email, text); and
(iv) for generating aggregated statistics about users, traffic patterns etc. of the WGSN website(s), as well as developing WGSN’s marketing plans.
4.2. Visitor agrees that WGSN discloses of Visitor’s Personal Data (subject in each case to the requirements of the DPA) as follows:
(i) to other organizations selected by WGSN or its partners to enable them to contact Visitor or send information by post, telephone and/or email, unless specifically indicated otherwise ; and
(ii) to any sub-contractors and agents appointed by WGSN to perform the above functions on its behalf and in accordance with its instructions.
(iii) to third parties selected by WGSN as part of aggregated and anonymized statistics about users, traffic patterns etc. of the WGSN website(s);
(iv) to such individuals and/or bodies as necessary to ensure WGSN’s compliance with any applicable law, regulation, legal proceeding or governmental request;
(v) to any relevant authority or third party requiring WGSN to disclose the identity of or locate anyone eventually posting offensive material on an WGSN website (being such any material that does or may constitute a criminal offense, breach the rights of a third party, give rise to a civil action or breach the Terms & Conditions of the applicable website and any material of which the disclosure, in any way, is necessary to protect the rights, property or safety of WGSN and its customers); and
(vi) to any individual making a subject information request to WGSN, at WGSN’s discretion.
4.3. In the event that WGSN (or a relevant part of WGSN) is acquired by or merges with another company, Personal Data may be passed to the purchasing/merging company amongst the transferred business assets. This will enable Visitor’s relationship to continue with the relevant WGSN business despite the change of ownership. Personal Data may also be passed (on a confidential basis) to companies with whom WGSN is negotiating such a sale/merger as part of the verification exercise carried out on WGSN by the third party.
When Visitor visits a WGSN website(s), WGSN uses “cookies” technology to try to make that experience simple, personalized and meaningful. • customise elements of the promotional layout and/or content of the pages of the website;
• store Visitor’s product selections to the shopping basket;
• collect statistical information about how Visitors use the website(s) so that WGSN can improve the website(s) and learn which parts are most popular to Visitors; and
• gather information through our advertising partners, about the pages on the WGSN website(s) that Visitors visit, and also other information about other websites that Visitors visit, so as to place Visitor in an “interest segment”. This information will then be used to serve interest-based advertisements, which it are believed to target Visitor’s interests. 6. Third Party Websites
Please be aware that WGSN does not control and is not responsible for any third party websites that are referred to or linked from its own websites and that use of Personal Data on these websites is not subject to this Privacy and Cookies Policy and shall be made entirely at Visitor’s own risk.
7.1. To access certain parts of the WGSN websites, WGSN may require Visitor to register and provide certain information.
7.2. In addition to the provisions of this Privacy and Cookies Policy, Visitor also agrees to:
(i) provide true, accurate, current and complete information about yourself as prompted by the relevant registration form (“Registration Data”); and
(ii) maintain and promptly update the Registration Data to keep it fully up to date.
8. Electronic Identity
Visitor shall assume full responsibility for the confidentiality and proper use of username and password, created when registering for WGSN website access.
9. Governing Law
The parties submit to the exclusive jurisdiction of the courts of England and Wales in relation to any legal actions or proceedings arising out of or in connection with this Policy, save that this submission will not preclude any party from applying to any other court having jurisdiction for urgent or interim relief in aid of proposed or pending proceedings in England.
